Rally Raise is a donation platform operated by Fresh Food Connect. These terms explain who can use it, the money split, and what happens if something goes wrong.
Who can use Rally Raise
- Orgs: US-based 501(c)(3) nonprofits, qualifying parishes, shelters, schools, and community kitchens in good standing with the IRS. We verify your EIN against IRS Pub 78 during signup.
- Donors: Anyone 18 or older with a valid US payment method.
- Share & Earn sharers: Anyone 18 or older. A W-9 is required before you receive more than $500 in thank-you share in a calendar year.
What Rally Raise is
Rally Raise is a platform that connects donors to verified nonprofit orgs. We are the platform. The receiving org is the recipient of your gift and is responsible for issuing the tax receipt. Rally Raise provides the data and a receipt template; the org issues the contemporaneous written acknowledgment required under IRC Section 170(f)(8).
Fees
Every dollar donated through Rally Raise is split three ways, disclosed before you submit:
- 94% to the org.
- 3% to Rally Raise as a platform fee. Graduated down to 2% above $100,000 per org per year and 1% above $1,000,000.
- 3% optional thank-you share to the person who shared the link that brought you in. The donor can opt that person out at donation time, in which case that 3% flows to the org instead (bringing the org's share to 97%).
Stripe's standard processing fees (roughly 2.9% + 30 cents on card transactions) are separate and are paid out of the platform's 3% share, not out of the org's 94%.
Only the portion of your gift that reaches the org (94% or 97%) is generally tax-deductible as a charitable contribution. Your receipt will state the deductible amount clearly. Confirm your tax situation with your own advisor.
Refunds
Donations can be refunded within 60 days of the gift. Email [email protected] with the receipt number. We'll coordinate the refund with Stripe and with the receiving org. After 60 days, refunds are at the discretion of the org.
Donor obligations
- Only donate using payment methods you own and have authority to use.
- Provide accurate information in required fields (name, email, ZIP).
- Don't use Rally Raise to launder funds, evade taxes, or otherwise break the law.
Org obligations
- Use funds only for the stated charitable purposes of your organization.
- Provide an accurate EIN and keep your IRS status in good standing.
- Comply with charitable-solicitation registration requirements in every state where you solicit donations. Rally Raise's multi-state registration does not substitute for yours.
- Do not impersonate another organization. If you claim a registered trademark you don't own, we will remove your page.
- Issue contemporaneous written acknowledgment to donors as required by IRS Publication 1771.
Share & Earn obligations
- Share honestly. Don't misrepresent an org's mission, impact, or use of funds.
- Disclose your 3% thank-you share when legally required. In most cases the FTC Endorsement Guides (16 CFR 255) require you to say that you may receive a small share when you recommend a donation. A simple "I get a 3% thank-you share if you give" in your post is usually enough.
- Provide a W-9 once your total thank-you share passes $500 in a calendar year. A 1099-NEC will be issued if you cross the IRS reporting threshold.
Prohibited use
- No political campaign contributions. Only 501(c)(3) charitable orgs are eligible. Politically-active 501(c)(4) or 501(c)(6) organizations are not allowed.
- No fundraising for for-profit purposes, private benefit, or personal crowdfunding.
- No donor-advised fund or private-foundation grants routed through a Share & Earn link. These sources cannot receive the 3% benefit without triggering IRS self-dealing issues.
- No scraping, reverse-engineering, or unauthorized access to the platform or its data.
Suspension and termination
We may suspend or remove an org page for fraud, impersonation, trademark infringement, Computer Fraud and Abuse Act violations, or material breach of these terms. Donations made before the suspension will still flow to the org unless a court, regulator, or Stripe directs otherwise. We will notify the org admin by email when we take action.
Disclaimer
Rally Raise is a platform, not an advisor. We verify that each org has an active IRS tax-exempt status at signup, but we do not audit every claim an org makes about its programs, outcomes, or use of funds. Please use your own judgment. The platform is provided "as is," without warranty of any kind.
Limitation of liability
To the maximum extent permitted by law, Rally Raise and Fresh Food Connect are not liable for indirect, incidental, or consequential damages arising out of use of the platform. Our total liability for any claim is limited to the amount of fees we retained from the transaction in question. This clause will be finalized by counsel.
Governing law
These terms are governed by the laws of the State of Colorado, where Fresh Food Connect is incorporated. Disputes will be resolved in state or federal courts located in Denver County, Colorado.
Changes to these terms
We will post material changes here with a new "last updated" date and email active org admins. Continued use of the platform after a change means you accept the updated terms.
